Legal notice

In accordance with article 6 of French law no. 2004‑575 of 21 June 2004 on confidence in the digital economy (LCEN), the following information is provided to users of servor.benode.fr. This is a courtesy translation; in the event of a discrepancy, the French version prevails.

The website, the API and the associated data are hosted by the following providers. Processing takes place within the European Union, except for the services expressly identified below.

Transfers of data outside the European Union are governed by the standard contractual clauses adopted by the European Commission (decision 2021/914), supplemented by technical measures: end‑to‑end encryption of secrets, encryption in transit, and minimisation of the data transmitted.

3. Nature of the service and intended audience

Servor is an infrastructure administration tool intended exclusively for professionals acting in the course of their commercial, industrial, craft or professional activity. It is not intended for consumers within the meaning of the French Consumer Code.

The Service executes commands on remote servers designated by the user. The user remains solely responsible for the infrastructure they connect and for the operations they trigger on it. Detailed terms are set out in the Terms of Use and the Terms of Sale.

4. Intellectual property

All elements of the Service — source code, interfaces, trademarks, logos, text, illustrations, animations and documentation — are protected by French and international intellectual property law. All rights are reserved to BENODE, save where expressly stated otherwise for open source components, which remain governed by their respective licences.

Any reproduction, representation, modification, publication or adaptation, in whole or in part and by any means, is prohibited without prior written authorisation, under penalty of the sanctions provided for in articles L.335‑2 et seq. of the French Intellectual Property Code.

5. Hyperlinks

The website may contain links to third‑party sites. BENODE exercises no control over those sites and disclaims all liability regarding their content, practices or privacy policies. Linking to servor.benode.fr is permitted, provided the source site is not defamatory, infringing, or contrary to public policy.

6. Reporting unlawful content

Pursuant to article 6.I.5 of the LCEN, manifestly unlawful content may be reported to contact@benode.fr. The report must state the identity of the notifying party, a precise description and location of the content, and the grounds on which it should be removed.

7. Personal data and cookies

Processing of personal data is described in our privacy policy. Trackers placed on your device are detailed in our cookie policy.

8. Governing law

This legal notice is governed by French law. Any dispute relating to its interpretation or performance shall, failing amicable resolution, fall within the exclusive jurisdiction of the courts within the jurisdiction of the Rouen Court of Appeal.
